“Race, color, origin, age, disability, gender, or gender identity” cannot be a reason for not ensuring healthcare in the United States. The "gender identity" was introduced by Barack Obama into the law, but it has now been removed by the Trump administration so it only takes into account the biological sex it has at birth and excludes transsexuals from this measure.

The legislative change will affect transgender people who want to start a transition process, as health and medical insurance can refuse to participate in gender identity processes on religious grounds.

Conversely, the representatives of human rights and the LGBTI+ group are of the opinion that legislative change may also serve to avoid offering health care that is different from that involved in the transition process. In the midst of a pandemic, they have criticized that Trump’s priorities have been made clear, which once again has rejected transsexuals and put them at risk, without guaranteeing health care. Several groups have already announced that they will go to the courts of the National Court to decide their future.

Days earlier, the White House Housing Department had proposed another measure related to transsexuals: expanding the possibility of not admitting transsexuals to homeless shelters (again arguing for religious reasons) or forcing them to use the rooms and toilets typical of biological sex that they were born.
