In June, the LAB trade union section of the City of Donostia-San Sebastian filed a complaint with the Prosecutor’s Office in Gipuzkoa to initiate an investigation. Last week, the prosecution filed the complaint on the basis of the lack of evidence of irregularity in the complaint. According to the union, however, the Prosecutor's Office has closed the case "without making an exhaustive study of our complaint, nor asking or listening to the parties" in the investigation.
Direction and project of the work
On the one hand, the City Hall of Donostia-San Sebastián awarded directly to the company LKS-Fhekor the construction management contract without bidding. The Prosecutor ' s Office, which recognized this in its resolution, does not see any signs of irregularity in the prosecution ' s activities. LAB of the City of Donostia-San Sebastian considers otherwise: "It is a scandal and, furthermore, it has uncertain legality. LKS-Fhecor launched prices to be able to directly award this project, but everyone knows that the amount offered by the company was not enough to carry it out.”
On the other hand, the union denounces that the City Council granted an architect “the drafting of the rehabilitation works of the building of the lighthouse of the island”, but that the project was actually carried out by LKS-Fhecor. “That is, one of the main works of the project was carried out without contract, without any explanation. A completely irregular case that the City Council has not explained to the prosecutor’s office.”
The decision to file last week’s Public Prosecutor’s Office cannot be appealed. However, the trade union has announced that it will consider "with the Legal Advisers for Livestock" the possibility of "moving forward" in the investigation of the market.
