The Basque High Court confirms that the Basque language requirement to work in shelters in Gipuzkoa is "discriminatory"
- The ruling makes it illegal for people without proof of language requirement to be excluded from the Public Job Offer. It was a verdict against the appeal filed by the Provincial Council of Gipuzkoa. The CCOO has reported on the ruling and has expressed its support for it.
The CCOO points out that the Superior Court of the Basque Country has confirmed that the call for a Public Job Offer (LEP) for cleaners of public shelters in Gipuzkoa has "violated the right of equal access" of workers.The Basque language requirement violates the "right to obtain jobs under the same conditions" according to the ruling. It's a verdict that affects 15 jobs.
In October of last year it was announced that the Basque language requirements imposed by a San Sebastián court on the cleaners of shelters in Gipuzkoa were "disproportionate and discriminatory". In response, the Provincial Council of Gipuzkoa announced that it would appeal. The spokesman of the Provincial Council, Irune Berasaluz, then reported on the position of the organization and stated that he would act in defense of the population: "Our mission is to guarantee the linguistic rights of the users of the public services we offer, and we are committed to doing so, as the society of Gipuzkoa demands of us." The High Court has now annulled this appeal and confirmed it in its initial decision.
CCOO satisfied
The CCOO criticizes the position of the unions and the Provincial Council. "It is regrettable that, as LAB and ELA have done, the unions are attacking workers who are trying to protect their right to work." In the same vein, he criticized the position of the Provincial Council of Gipuzkoa and said about the appeal: "It is a shame that the Provincial Council is insistent on not complying with the Government's language regulations." He points out that the Provincial Council has an "exclusionary and segregating attitude" against people who do not know Basque, understand it but do not speak it or achieve a profile.
