The Social Court No. 7 in Bilbao has estimated the appeal submitted by the ELA union and concluded that the company Novaltia has violated the right to strike.
ELA sued Novaltia in March 2021 for the three changes to the labor agreement. The judges have agreed to the union and have concluded that the change in the working hours of the drug distribution company is contrary to the right to strike. Therefore, two of the three amendments introduced by Novaltia in March have been annulled by the Constitutional Court.
The Social Court No. 7 of Bilbao has not annulled the third amendment of the collective agreement denounced by ELA. Specifically, according to this change, workers who are not on strike receive a special remuneration of EUR 300 per month. The Court takes the view that this is a matter that must be resolved in another kind of procedure. ELA does not rule out the possibility of recourse.
Novaltia workers have been on indefinite strike for 812 days to call for improvements in their working conditions. During these two long years the company has refused to negotiate with the strikers. In Aiaraldea too, this prolonged unemployment has been echoed, as strikers have concentrated on several occasions before the pharmacies of the region to denounce the responsibility of these establishments in the labor conflict:
