According to the Israeli media, the court may in the coming days issue arrest warrants against Prime Minister Benjamin Netanyahu, Defence Minister Yoav Gallant and Israeli Army Chief Herzi Halevi.
But the ability of the NZA to judge Israel is in doubt. The Zionist State has not signed the Rome Convention, as the US has not signed, which empowers the International Criminal Court to try. Consequently, this Court does not have its own competence to investigate Israel. However, the CNS has competence to investigate crimes committed by a Member State or on the territory of a Member State. Palestine is a member of the International Criminal Court, following the approval in 2015 of the request of the Palestinian National Authority. The CNS can therefore investigate the killings in the West Bank and the Gaza Strip and send arrest warrants against anyone, including Israeli soldiers and authorities.
Israeli Prime Minister Benjamin Netanyahu said on social media that Israel “will not accept attempts by NZA to question the right to self-defense.” He added that “even if it did not condition Israel’s action, the CNS would set a dangerous precedent.” In addition to these possible arrest warrants, Netanyahu has reason to concern himself in Israel as he faces two trials. The first, accusing him of corruption charges and the second of the security errors of 7 October.
