In this particular case, there was a question as to whether it is legal for the police to record when they are “working”. In reality, it is the right of citizens to record a public official doing their job. Even the Mozal Law includes this right: recording the police is our right. But the government tried to convince him, with Axier Lopez, or through Axier Lopez, that it was illegal to film the police.
To a certain extent, even achieve it. A lot of people will think that nowadays you can’t record the police, especially if you’re not a journalist. Well, no, no! The Government had been paralysed by numerous denunciations, solidarity campaigns and mobilizations and would not implement the law at its discretion. Recording the police is our right. Let's use it.
Of course, the Gag Act is not limited to journalists or photographic and image matters. Since its adoption in 2015, the Mozal Law has been applied thousands of times by police officers of all colors in the Southern Basque Country. Waiting for the data of Navarre, we know that in the Autonomous Association there are more than eight thousand cases. For participating in mobilizations, for freely using social networks, in press conferences, for talking to the police...
Some people have surrounded themselves to a lobby in Altsasu, a doorway to the house. They set up tables and chairs. Then came the reporters. The initiative, which has all the permits, has been announced: the homes of the people who have been prosecuted in the village will be linked by a chain of people. After thanking the participants, the attendees greeted each other.
Not all participants were present, no. There was also a participant at that press conference who was not seen, as a few weeks later a fine has been imposed on several people who were present at that press conference.
It’s an example; we can put eleven: From both the Basque Country and the Spanish State: for not eliminating the photographs of the Civil Guard in the incident of a work accident; minimum income was demanded for all people for accompanying a wounded person in the demonstration; for carrying in a bag “All cats are beautiful” (sic); for engraving the police confiscating the fish; for photographing with some player outside the football field; for photographing the police car parked in the disabled square.
All of these examples draw our attention to what, in our opinion, is one of the most important objectives of the Gag Law: the spread of fear. They want to spread fear. They have no testimony of the abuses committed by the police, no. They want to act with impunity.
And also with total submission. Let no one question their order. If you don’t like the poster, remove it yourself; if you don’t like your shirt to remove it; cancel your mobilization. I mean, to be the leaders of the street.
If, on the other hand, we make a more general reading of all the cases that are being reported, we will realize that the purposes and objectives of the Gag Law go beyond offering impunity to the police that circulates in the street. They want to restrict freedom of expression completely. They want freedom of speech. Absolutely, absolutely, absolutely. They want to transform reality into the Freedom of Expression used by countless organizations, movements, associations, organizations, parties, unions, collectives... that we have written in serious letters.
But also the freedom of expression that any citizen, any worker or unemployed, any woman or man uses, which we have written in small letters. And this isn't any more funny. Because it can lead us reluctantly but to accept reality. Because it can lead us to shut ourselves up. Because it can make us feel alone in the face of power.
New witch hunt; objectives, eternal: end dissent, eliminate dissidents. Let him be a dissident, in any case, on his couch.
ELEA/LIBRE believes that it is necessary to go deeper in the other direction. Our civil and political rights are and must be exercised. We must use them because they are an indispensable tool to develop as a person and also to move forward as a society. Less and less rights, ever closer to the dictatorship. More and more rights, closer to freedom.
In the coming weeks we will develop an initiative with two branches. On the one hand, we have offered new tools to those affected by the Gag Law so that they are not left alone in the face of fines or court proceedings. We’re going to divulge some numbers for the following purpose: the person who receives a fine related to the gag law, contact us. We're in the neighborhood with a bunch of lawyers. We will analyze the case between each other and activate solidarity and denunciation mechanisms and/or help activate them.
The second branch of the initiative brings us to Parliament, which is curious about what happens with the Mozal Law in the Southern Basque Country. The political majority is against the law, as has been expressed by most political parties. Both Parliaments have adopted declarations contrary to the Mozal Act.But the law, as we have thoroughly tested, applies. A law and a situation more unjust than this?
We have requested appearances in the parliaments of both Pamplona and Vitoria-Gasteiz for two purposes. To reaffirm their opposition to the Mozal Law and to strengthen their position with regard to the application of the law. We believe that by pulling on the one hand and on the other, we can make the extent of the injustice of the Mozal Law visible. Once this is achieved, it will be easier to either go over the law or get suspended.
The path is clear, so go ahead!
