"Those who were in Plaza Gipuzkoa called us and we went there to see what was going on. A large police operation surrounded 20-30 citizens in the square. There were also street dressers, and we asked them what orders they were responding to," recalls Haizea Núñez, a lawyer who runs the legal department at Gipuzkoa Zutik, which took place on June 2. "We were told that the order they received from the Department of Safety and Security was to identify two members who needed the names of the two people in charge. We communicated to the members of Gipuzkoa Zutik who replied that they were all responsible, that they would not give the name of anyone. The police identified two individuals, but in addition to carrying out the order they received, they were handcuffed and arrested. That is why we have filed a complaint against them, as it was an illegal detention."
Ercios Gipuzkoa Zutiki, fines
The two members were fined €602 on the basis of the Gag Act. If you pay within 15 days, the amount is reduced by half and you have decided to pay. Before the judge, the police denounced these two members for the crime of disobedience, but the judge, with the police report in hand, closed the case, resolving that there were no signs of crime.
Gipuzkoa Zutikek to the riders, denunciation
The three gunmen who arrested the two members of Gipuzkoa Zutik have been identified and Gipuzkoa Zutik has filed a complaint against these three, denouncing their illegal detention. Núñez explains, "We have asked the judge to identify all the border guards who participated in this operation and also to clarify the political responsibilities, specifically who was the one who made the decision to take these members away." According to the judge, there is sufficient evidence in the facts to conduct a judicial investigation into illegal arrests. He has therefore ordered the summoning of three border guards who have already been identified so that they can appear before the judge as investigators.
Possible fines and assumptions of causes
According to the lawyer, so far 15 to 20 people have been identified in the actions of Gipuzkoa Zutik (the last, counting those that were identified at the beginning of the Festival). The following fines could come from these IDs. The lawyer explains that some fines could come “for not identifying or organizing an unreported rally” (in these cases the fines are between 100 and 300 euros), while other fines could come “for disobedience” (in these cases the fines are between 300 and 600 euros). The lawyers, taking into account the amounts of identification that Gipuzkoa Zutik has today, foresee that it can receive a total fine of 9,000 euros.
However, for now, Núñez sees the possibility of the following fines being exempted: "My hypothesis is that these two fines simply want to justify the attitude of the gunmen that day. He put himself at the head of some authority 'we are going to cut off this indefinite camp with arrests', and since this did not happen, they want to give a body of fines to this path that they started. If fines come with the rest of the cases, there would already be signs of seeing a political objective behind this behavior, of trying to strangle the Gipuzkoa Gora movement through fines. Not yet."
Gathering of those sanctioned by the Mozal Law
Tomorrow, 15 October, at 11:30 a.m., all the agents sanctioned by the Mozal Law will appear in San Sebastián at the City Hall. More than 20 citizens have been fined in San Sebastian. For his actions in Santo Tomás, Popular Walls, May 1st, University, Gipuzkoa Zutik and Cork, among others.
Responsibilities in the collective
Gipuzkoa Zutike began its journey with an unlimited camp and from the beginning it has been based on the principle that "we are all responsible". It has taken its decisions in the Assembly and has not appointed a person responsible. It is for this reason that the police have so far been responsible for the events through the identification of some of its members. From the outset, the emphasis on collective responsibility in the assemblies of Gipuzkoa Gora has been clear, even in the payment of fines. As a result of these first arrests, they began to form a bag of money to cover any expenses that might come. The current account has been expanded so that, as a result of actions for the benefit of all citizens, a small number of individuals do not have to pay fines from their own pockets: (From Laboral): ES52 3035 0075 41 0750057088.
