The companies that built the illegal chalets in Barrika will receive a public compensation of 1.5 million euros
- The High Court of the Basque Autonomous Community (EAEAN) has ruled in favour of the companies that built the villas in the protected area of Barrikabaso in Barrika (Abandonada Muriola S.L. and Inversiones Arne Muriola S.L) and the public entities that authorized it will be subject to compensation of 1.5 million euros. Despite the approval of the project by the Provincial Council and the City Council, the Basque Government rejected it twice, arguing that the area is not urbanizable.
Fourteen chalets have already been built in the protected area of Barrikabaso, which were in danger of being demolished as a result of the judicial decision. The construction companies had prepared a larger project under the auspices of the Provincial Council of Bizkaia and the City Council of Barrika, but the court ordered the project to be abandoned. Now, the EAEAN, for the damages caused, has ordered the two public entities to pay compensation of 1.5 million euros.
In 1990 the project included 349 chalets, a hotel and a golf course, but the Basque Government had declared Barrikabaso an undeveloped area by 1988. In 1997, a second attempt was made to build 85 chalets and 12 floors, but they were again rejected by the Government. The ecological organization Chipio Bai appealed three times to the attempt to re-qualify the area, which was cancelled. In 2015, Barrikabaso was declared a special protection area.
The construction companies entered the bankruptcy of the creditors as a result of the cancellation of the operation and demanded compensation. The Court has given them a reason, but not in its entirety: the companies will receive 1.5 of the 4.9 million euros requested.
