Slow judicial investigations are affecting one of the parties to the Zaldibar landfill lawsuit, which fell in 2020. The Prosecutor’s Office says in its report that the issue brought by the Durango Audience is “technical complexity” and that “progress and development are not fast enough”. This section of the matter is examining whether or not the facts were environmental crimes and whether the Government had responsibilities. At that time the Environment Minister was Iñaki Arriola.
In the news published by the media Eldiario.es, Iker Rioja explains that the investigation of crimes is the responsibility of the Ertzaintza, unless the issue exceeds the scope of autonomy, for example in the case of explosives or those related to the coast. And that the 2020 report of the prosecutor's office already talked about the "deficiencies" of the research work of the Ertzaintza. Environmental issues are part of the Department of Economic Development, Sustainability and the Environment, chaired by Arantza Tapia, and in 2022 were the responsibility of Vice-Advisor Amaia Barredo. The Court of Vitoria-Gasteiz, through the Prosecutor’s Office, investigates whether it committed irregularities in the processing of the authorization granted to the Bergara Valogreene Paper project. In July he left the office of Environment of the Government and became a member of Álava.
The 2022 report of the Public Prosecutor’s Office contains in writing the weaknesses in the investigation of corruption in the Basque Country: "More instruments are needed to investigate crimes and, of course, people who report offences must be clearly protected." The document signed by Adam also states that "the difficulty of detecting criminal conduct in the field of public procurement remains evident."
