In compliance with the above, the Government of Navarre appealed this morning to the Second Section of the Court of Navarre for the 2016 Sanfermin gang rape sentence. The government’s legal services have declared that Articles 178, 179 and 180.1 of the Penal Code violate the sentences declaring rape as ‘sexual abuse’. Moreover, the Government of Navarre identifies five sexual assaults in the prosecuted act, and has therefore requested the annulment of the previous sentence.
For its part, the Government of Navarre has submitted a new criminal petition for the five defendants: eighteen years and nine months in prison, which, once this period has expired, would lead to a custodial sentence of ten years.
A crime against privacy has also been detected in the appeal, for which a sentence of three years and three months in prison and the need to pay compensation of between nine and fifteen euros over a period of twenty-one months has been demanded.
In addition, an additional three-year sentence has been requested for one of the defendants for stealing the victim ' s mobile phone with violence and intimidation, according to legal services.
A total of 22 years in prison has been requested for four defendants and 25 years in prison for the fifth.
