Report on Euskaphobia of Judges to the Superior Court of Justice of Navarra
  • They have concentrated themselves before the Superior Court of Justice of Navarra to report the last judgment handed down against the City of Zizur Mayor. The court disregards the linguistic profile established by the City Council in a job.

The City Council of Cizur has taken nine works and one of them has established the linguistic profile. The Administrative Tribunal No. 3 of Pamplona annuls it as a result of an action brought by UPN. Previously, when the first appeal against this bilingual profile was filed, the Administrative Tribunal of Navarra opted for the city council. The court then said that the Basque requirement was “absolutely legal.” Against this decision, a new appeal was brought before the Pamplona Litigation Court, which has handed down a judgment against the City Council.

In the meeting, against the Basque Country, the following agents showed sentences and a banner: EHE, ELA, LAB, STEILAS, Geroa Bai de Zizur Mayor and EH Bildu.

Agurne Gaubeka, Director of the Centre: "They always take us to the same place."

In the opinion of Agurne Gaubeka, director of the Observatory on Linguistic Rights, the City Hall argued that a Basque level should be required, that is, that this worker should relate to the citizens, to the educational institutions and to the house of culture. The Basque woman participating in the meeting, Ana Gurpegui, has presented some examples of the relations that this worker would maintain with the citizens: The act of Olentzero, the parade of kings, the fires on the eve of San Juan… In several previous courts the demand for the linguistic profile has been rejected on the grounds that the worker will not be related to citizens. In Zizurko, the City Council has determined that it will be related to citizenship. But it has done nothing. Agurne Gaubeka explains to Euskalerria Irratia: “(…) But they rejected it the same way. When one excuse isn't worth, they look for another one. In other judgments there is talk of proportionality or that the post is not connected with the citizens. In this case, and although all this is justified, it is said that the implementation of this profile in Basque is discriminatory for those who do not know the Basque country. The truth is that this ruling is part of a judicial and political strategy that we are seeing throughout the Basque Country.”

With arguments, for Gaubeka, judges “always take us to the same place.” Ahotsa.info points out that some claim the right not to be attended in Basque, a right that does not exist: “When the conditions for access to any public post are set, they are met and no one argues otherwise. On the contrary, when the Basque country is established, we see what attitudes it produces”.
